(4) It should be illegal for builders to tell homeowners to send in their work requests via an internet form when only requests by certified mail will stand up in court. Or internet work request forms should have a disclaimer explaining to homeowners that only certified mail will stand up in court. HOMEOWNER STATEMENTS Statement 1 : We spoke to our builder many times regarding the leak and sent in several forms from their web site. When our case went to court, it was dismissed because the builder claimed we never contacted them. We went back to court a second time and the judge ruled in our favor. Our builder told us to contact them by computer, and we did. Then we went to court and had our case dismissed by the builder's attorney for following the builder's directions. This was not fair and very stressful for senior citizens. If the builder had told me to send in a registered, return receipt letter about the leak, I would have. We used the computer because they told us to. This is why I think builders who use internet work request forms should be required to disclose on their web sites that only registered, return receipt work requests will stand up in court.
