(1) The Nevada New Home Lemon Law.
A builder has 2 attempts to make repairs that seriously diminish the value of the home. If after 2 attempts to fix the problem, or 2 notifications by certified/return receipt mail, that such a problem exists, the builder cannot or will not make repairs the builder must:

Buy the home back at the market value or the original purchase price, whichever is greater. Or, replace the home with a similar home. It is the buyer's choice as to which option is implemented.

HOMEOWNER STATEMENTS

Statement 1:

The garage in all of the homes in my subdivision were built too small causing for all neighbors to keep parking their cars on the street. The neighborhood looks like a downtown, old neighborhood.

Statement 2:

The market value should be determined by a third party. Homes in Las Vegas are being built too rapidly and in a shoddy manner. Building defects should be the responsibility of the builder and any and all assigned subcontractors. Homeowners should not bear the brunt of costs incurred when repairing a house that was poorly built.

It is the responsibility of a builder to sell a well built, safe home.

Statement 4:

I have a Centex home in North Las Vegas, since I have moved in there has been problem after problem. Some Items have been fixed but some have not been. They have taken their time to fix things and now are taking even longer. I am in full support of any legislation that would make builders accountable. Please let me know if there is anything I can do.

I have had several instances where defective items have not been repaired/replaced on my Richmond American home. Trying to obtain cooperation from a new homebuilder after the house is purchased is nearly impossible.

Statement 6:

The builder should be responsible for his material and work ethics.

Statement 7:

Urine and mold were found in my brand new Richmond American Home. Richmond American refused to clean up the urine for weeks. The head of customer service said, "By law, we don't even have to wipe that up. We just paint over it." As new liquid appeared in the home, Richmond American claimed, "That is not new urine, it is old urine. It is so hot in here, the urine has sweated out from the walls." After a local TV reporter became interested in my story, Richmond American finally replaced the sheetrock and re-grouted the bathroom.

No one should ever be treated like I was treated by Richmond American. Some type of committee should have been able to step in and just tell them to buy back my house due to the urine and mold that existed before I had ever even moved in. I should have gotten back all of my deposit money, etc.

Statement 8:

Any problems to a home caused by a builder's negligence should be repaired by the builder after 2 notifications.

Statement 9:

I feel there should be consequences and compensation for homes that were not built well, and that are in disrepair. All homeowners deserve to have quality homes.
